I just recently got a ticket for "failing to yield to a pedesterian." What happened was this lady cross the street, on a cross walk, right at the moment that I was getting closer to her. She practically darted out like there were no cars coming! I stopped and then she continued walking. Then this cop pulls me over and said that I almost hit her and that I was suppose to yield for her. If I almost hit her then why didn't she flinch or jump or anything. It didn't even bother her. She just kepted walking. And, if I didn't yield for her then how did she cross the street in front of me? The crosswalk by the way is painted white and wasn't at an intersection. The cop was being a bitch about everything, almost refusing to tell me what I did wrong. She couldn't even give me a straight answer and told that if I wanted to fight...go to court. I had to ask her a couple times before piecing together what I did wrong.

My questions are, 1.) How much will the ticket cost 2.) Will there be a point on my record 3.) And, do I have a chance of winning if I fight it?

try to locate that lady that cross the street, get a written testimony from her and bring it to court. Other than that I see no other way to prove you were right.
1. not as much as insurance hike
2. yes, I believe that is a moving violation.
3. no not without a good lawyer or a testimony of the lady who crossed the streets.

Judge tend to believe the cop.
Afterall no point finding you innocent when finding you guilty = revenue for them.
You have to be prepared before going to court with either Lawyer or well prepared testimony.

dude find some random lady...take her to court with you and say she was the one...the cop won't be able to prove shes not the lady... LOL it may work...

this may be a stupid question...BUT....
if you failed to "yield to a pedestrian", wouldn't you have hit her? in any other form, you did yield to her, because she crossed in front of you. if you didnt yield, shed have either been part of your front end, or she would have walked behind your car. hell, go to court and tell them that. ive never heard of a law that has a "minimum yield time", but perhaps that is the law you broke. also, if there was a fine, wouldnt you know what it is?

i got a ticket a few years back for "not stopping at a stop sign long enough". it was $85. it took the cop 4 miles to pull me over. if i ran the stop sign, wouldnt you notice right away? he just didnt like that i was driving a little black car w/ tinted windows and FL plates in RI...(he thought i was a drug dealer!)

Thanks guys for the help. Yea, I'm going to fight it! That lady was way to close for me to yield to her at a distance. And also the cop being a bitch about everything was the worst part! I'll try my best to win.
