my friend got a DUI for the same reason, blew a .082 over a .08.. both of you are still dumbas**s in this case but anyways this is what he did....

get an attorney... the attorney then had him go to this weekend seminar about drinking and driving since he was a first time offender and that close to the limit. then do exactly what the attorney tells you to do.. any other classes and/or tests and such. they sound gay but they will help in the end.

i think in all he lost his license but w/privledges (to school or work driving only) for 30-90 days, im thinking closer to 30 days but cant remember... and paid about $2000 with attorney fees, license reinstatement, ticket fee, and class fees. and little bit higher than if he would have just payed everything and didnt fight it, but the DUI was then dropped from his record. BUT he was told if he got another DUI then hes up sh**ts creek without a paddle. good luck hope this helps.

1st DUI is usually not as stiff, get a lawyer or plead guilty, then go to required AA class. Your 1st offense is usually a misdemeanor. Thank the heaven above that you didnt hit anything or anyone.

Take this a learn from it; the biggest pitfall is getting a SECOND DUI. Do what you must to never drink and drive again.

It also depends on your job. Going to Officer Training School, they said one of the fastest things to ruining your career is getting a DUI

I used to work in a court in LA and the usual outcomes of DUI's are suspension of license, a huge fine and community service (I'm assuming they arrested you that night). Depending on your attorney you may get away with the suspension of ur license...

It's mainly because the drunk person doesn't flinch or brace during the accident like a person who would see it coming and tense up.... You're also less likely to have a panic attack which could lead to shock.... Of course those that are hit usually don't make it and you get manslaughter to 2nd degree murder charges.....

I found out you can avoid paying a lawyer for tickets here in vegas,
by just going to the court house, and see the clerk with your ticket
and ask them what deals do they have for this ticket.
My wife got a speeding ticket, we paid a lawyer $100, and he had it
reduced to a parking ticket and pay the fine. we had to pay at the court house. 2nd time she got a ticket, we just went to the court house, and got the same deal, no lawyers fees, and it was reduced to a parking ticket, and
it doesn't get reported to the dmv.

You should be able to get the same deals where you live, just as all other first time offenders, go try it. If not, then seek an attorney! because they are all ripoffs and hardly do any work for thier money!!!

There should be some sort of disclaimer on here about not posting threads about drinking and driving. All you get is the ******s around here who act like drinking a beer and then driving home is some major crime. Frankly, three beers over say two hours you shouldn't be at a .08. If you really got nailed for three beers, that sucks but since you were so close to the limit you should consult a good lawyer. But honestly, why in God's name would you drive around with a headlight out if you knew you were going to be having a few beers? That's just plain stupid.

Above a certain level it is, below a certain level it is perfectly legal. The law is written that way so that everyone can go out to a restaurant and have a drink with dinner. Its there to deter people from getting impaired and driving. In this guy's case, with a 0.082 or whatever, he'll never get a DUI conviction with any sort of decent lawyer.

My roommate actually has this cool breathalyzer his parents gave him for Christmas a few years ago. We were testing it out the other day. After hockey on Wednesday, we had a beer in the locker room with the team. Sat around for about 15 minutes then drove home. The breathalyzer said he was at a 0.01. The interesting part was last night he opened a beer, took one sip, then immediately used the breathalyzer. It said he was a 0.06. So I guess the moral of the story is if you're having a beer with dinner or some friends, wait a little bit before going anywhere.
