Some mad insanity goin on over at the vwvortex forum....
A guy got ****ty service by the dealership service dept and now they're suing him for libel on a message board!!!

wow I must be really bored... i just read the whole thing.... i can see why people are ralliying behind this dude... if the dealership wins it'll establish precedent for any other dealership to call slander whenever anyone posts anything about a certain dealership by name...

This is just an attempt at intimidation. They have the money to pursue a losing case. This is not a "fine line". Opinions and reviews have always been protected speech. If the logic of this motion were used it would mean that food reviewers couldn't right bad reviews for fear of libel. Libel and slander have to include purposely false statements with the intent to defame. In this case there is no purposely false information. The dealership is just trying to intimidate the web site and chill free speech. I doubt they even get a restraining order, if I were the web site I would try for summary judgement. This also brings up another point of concern for me and the internet, how in the name of hell is the web site responsible for it's members actions. How that doctrine ever developed is beyond me.
Oh and no I'm not a lawyer, but I did stay at a Holiday Inn Express last night.

I hear ya, i started in on it myself and just kept reading... it just amazes me that a dealer can actually be that retarded. I recall when I wasnt satisfied with the work the dealer did on my celica when i got it and contacted customer care.... ever since then they roll out the red carpet when i pull in the garage....
I cant help but feel for the guy, i dunno what i would do if i were in the same situation.

Woah. Thats pretty insane! looks like the case was dropped, but man I hope he counter sues them. Or gets a nice settlement. Friggin idiot dealership. It's amazing how they have been in business for so long..

I bet the dealership tried to go to court & VW didn't know about it. I'd put money on it that VW found out and reamed the **** out of Jim Ellis. I hope that they fired all the @$$ holes that gave the bad service. I had some bad experiences at dealerships & now they get no sales from me or anyone I know.
