View Full Version : Speeding Ticket Help Pls!!!!

aight,
i'm drivin home at 4:15 am a few nites ago. no one on the street...i'm speedin...not that fast tho, like 55mph, in a 45 zone. im tired so i didnt pay too much attention to on coming traffic (i didnt look for the cop lites), i jus wanted to get home. anyways...i driving, all of a sudden i see the cop headlites (not siren lites, jus the reg lites)...as soon as i see him i slow down but sucker busts a U, turns his lites and siren on and goes after me. i pull over. he claims i was going like 60 mph and wrote me for estimated speed 60mph and on the ticket he wrote 55mph.
now i heard that a cop needs to radar u if both cars are in motion and in opposite directions. all this guy was doin is guessing, but thats bull cuz we both drivin in different directions.
now my question:
do any of u know how to fight this, in court? how do i get out of this. can he do this? will he win, will i? he was going like 45 and i was suppodly goin like 55? how he know?
any suggestion are appreciated, thanks

you should have asked for a reading b4 he gave u the ticket cuz he has no other meanz of reading ur speed.....unless he is right next to u and he was going about 45 and u were speeding past him or something like that........u should always plea "not guilty" .....not too sure how it works over there but over hear (long Island,ny) ...i'v gotten like 3-4 speeding tickets in the past 1-2 years......and when i plea not guilty and go to court, it always gets bump'd down to a seatbelt charge and speeding ticket fine. Which i don't care about cuz it won't show points off my lisence

The ticket should say how he determined you were speeding (whether it was a radar or pacing, etc.). Either way, if he was coming from the opposite direction then there is no way he could accurately gauge how fast you were going. Even if he got you with a radar gun, the reading would be totally invalid because he was in a moving car.
Go to court and state your case. Or do what I did which was do a "trial by written declaration." Look on the back of your ticket for details on this. It's basically the same as going to court except that you write your story and the cop writes his. The judge goes by the written statements. Realistically, the cop is not going to spend any time writing a story, probably doesn't remember anyways, and you win by default.

I wouldn't stress too much about it, your seem like it'll get dismissed easily.

Radar can be used in a moving car and accurately clock someone going the opposite direction. :)

Genius, I am a police officer in NM. I posted you some very good info. at Celica.net. Also for whoever said radar can't accurately measure your speed if cars are moving in opposite directions. That is not true, radar is able to measure your speed either from same direction or opposite direction. The only one is laser, that one is not mobile, and is only able to measure stationary.

Next time you get a speeding ticket pay the ticket. But add an additional $30-40 to it. This way the court has to send you the refunded money back, which you should not cashout. They can't process your account unless you cash the refund. After a while the ticket is disgarded and never sent to DMV. No points, no record, just some extra money down the toilet. :evil:

are you saying that the points and record is based off that refunded money? i just got a speeding ticket, doing 85 in a 65, in the middle of 3 cars, guess who gets pulled over, THE CELLY! Had a blazer in front and a cavalier behind me coasting along! Does anyone think there is a way the judge may let me just pay the fine and throw the points out? i had it happen about a year ago? otherwise I might be loosing my license! DAMN IT!

You said you just got speeding ticket, but then you say it happened a year ago. Which is it? If it's a year ago then your points are alreading reported and record Dude.

no it was this past friday, I had another speeding ticket about a year ago that they took the points off, just had to pay the fine! was just wondering if you think i could get away with the same thing this time....It is about an hour and a half frm my house also, so would the plead not guilty and write my side of the story to the judge be my best option?

Maybe it was the laser I was thinking of that can't clock while moving. In any case, my point was that you should fight the ticket because you could easily win by default if the officer doesn't show up to court. I did a trial by written declaration because in my county it is mandatory for cops to show up on court dates. Plus I figured a cop either wouldn't remember the situation, or even take the time to write his version of what happened. 2002SilverCelica might have something to comment on that.

This is true if you go to fight the ticket and the oficer does not show it will be dismissed... it is also false that if you enclose extra money or not the point's are going to go on your record. weather you pay your fine or not once convicted the court will file the paper work. your only hope in beating the ticket is the officer not showing up.... as for the one who go the speeding ticket and got sinlged out from the other 2 cars what are you going to tell the judge I wasn't the only one speeding. the officer can not get every body at once and just becuase he nabbed you does not mean that he didn't radio in and get the other's nabberd down the road the fact is you were speeding try fighting it if he doesn't show you win if he show's you pay your fine

It is very pertinent that the officer who issued the citation show up for court. Due to the fact that another officer can't testify to what the original officer had made the stop for. If that happens, move for dismissal due to speculation or hearsay. Remember that hearsay is never admitted. The officer should be responsible enough to show up for something he is ordered by the court to do in the first place. If it doesn't get dismissed ask for a deferment, if you don't get a ticket for 90 days or 6 months the ticket with be dismissed due to compliance with the court order and the law.
