View Full Version : just wrecked and got a ticket.

Heres the story:

I was goin down this road. its was wet day but not rainly. As I was curving throught this curve road, I slid and went off the road. Luckly I didn't hit a tree. and my celica was not too damage. Now that police wrote me a ticket for "too fast for condition". I wasn't speeding. The tow truck, cop, and friends said this is like the 10th time for the month people had wrecked here. So should I go to court or something I can do? B/C theses no sign for the curve and so many wreck happened here. If i go to court, do I pleage guilty or not? If I pleage guilty, don't I have to get a lawyer and pay extra money?

If you challenge it go to the judge saying there is not a sign posted that the road curves and (if there wasnt) that there is no speed limit sign.

whats the speed limit? did you attempt to slow down on a curve or did you just maintain your current speed and relied on the excellent handling power of the celica?

Unless it's a blind corner, there's no reason why a speed limit sign should have to tell you how fast you should go into the corner.

If you lose control of the car. No matter what the weather or speed. You're going to fast for conditions pleage guilty? you don't pleage anything, you plea. And no, you don't have to pay any more or get a lawyer but you can throw away your money on one if you wish.

There was a 25 mile speed limit sign but i was going under it. But theres no curve signs plus tons of wreck happened at that spot and they never do anything about it. what my question is when i showed up at court. they gonna asked me if I am guilty or not. What should I do?

You have three options: 1 - pay the ticket before the court date. This is essentially pleading guilty. 2 - on the court date plea guilty. you will then have to pay a fine. Essentially the same as option 1 but wastes more time. 3 - on the court date plea not-guilty. Use this option if you want to contest the charge. In most states you will then be given another court date to testify. On the second date you will either represent yourself or you will have a lawyer represent you and you will give your account of what happened, be allowed to question the officer signing the charge and state why you believe you are not guilty of said charge against you. The judge will then make a decision as to guilty or not-guilty. If found not-guilty you will be clear. If found guilty you are back to option 1 with even more time wasted.

Uhmmm no? How does that work? You're saying that 100% of the time you wreck it's your fault?

unless it is due to another motorists actions or some unavoidable hazard (ie: tree in road, brakes malfunction, etc...) it would be your fault. this is common sense people.

Pay the fine, take schooling, if it doesn't raise your insurance it seems like such a minor ticket and move on. That's how it works here in CA.

If you really are bothered take it to court I would it'd be a great learning experience for you whether the outcome is good or bad. I don't think this is really a huge deal. You're okay and you weren't caught D.U.I. or have to go to jail for it.

From the sound of it, it seems like it's in the back of your head. If you have hard facts, & evidence that people have colided in that a number amount of times it may hold up in court but I highly doubt the judge will care. If you want to take it all the way get a lawyer who won't charge you if you loose the case. Some lawyers will even do it for free. Look around.

I took a cop to court for a speeding ticket that I was written up for, for pacing traffic when it was the other car ahead of me. I was wrongfully written up for it and the cop was a no show so you might get lucky and your case might default but don't look forward to it some cops make sure they go to ruin your day.

2- Most of the time here. If you show up on court date. They'll lower points & fine.
You might get lucky and the cop might not show up. But don't count on it.

its not sharp at all but the raod was really oily.

IF I plead not guilty and I loses, Does it cost more than it was? So If I get a lawyer and I might won, theres going to be a lawyer fees. Isn't that same as paying the fines.

Yep!... same goes for snow.... although... ice can get attributed to "Road Conditions". They'll even cite you if you don't have an accident for "too fast for conditions" if they observe you.

I doubt it that the oil is still there on the road. It was from the car gasoline, just like everywhere else. But there is no sign indicating for the curve. I am goin to see if I can talk to the judge early before the court date.
