So I think the way I got pulled over was total BS and the cop was just being an @$$ because I drive a sporty looking car.
I was driving down the highway towards Austin and come up behind a cop about 5 car lengths in front of me. He is also driving although he is in the lane next to me. I am gaining on him but then smash on my brake when I see him. All of the sudden, he flips on his lights and slams on his brake to almost a dead stop on the high way. I pass him up going 50 because I already slammed on mine. The second I pass him up, my valentine 1 goes off. Through out the whole trip up to Austin, I caught every single cop. So I thought there was no way in hell he could've clocked me before then. He pulls me over and says I was doing 85 in a 70. I cooperated and left when everything was done.
I think this is total BS because there is no way he could've clocked me while I was behind him.
Opinions? Should I fight it or ask for defense driving to get it off my ticket? I am 16 and in risk of losing my license. I don't know if you all think I'm just another teenager that deserves what he gets but, I don't think so. Help me please! Anything will help!

Just wondering, how could you not see him though, busy highway? and were you really going 85 or is he just saying it.

it would be hard to prove your speed inless you had people in the car, his word against yours....

agreed, but itzsuzi has a point. He would need to have a way to prove what his radar picked up, and I doubt he was pointing it backwards while driving down a busy highway.
Although, were you really doing 85 in a 70?

it wasn't a busy highway. i was going about 80-85. I had my cruise control on. I know, don't do the crime unless you can do the time. But I'm just saying, there is no way he could've clocked me right?
In order for him to prove I was going 85, he would have to have a report out of the radar gun that said I was going 85 right?

i would just quit right there, if he said he got you on radar it really doesnt matter, a police officer has the ability to "pace" a vehicles speed and doesnt need radar.

but the thing is, he was so far ahead and how could he "pace" me when he was going like 10mph?

Eh, dont think it matters, court will be in his favor. Just do the defensive driving crap. I got pulled over for 26 over, 1 mph away from defensive driving in my town, and i got stuck with community service. That sucks.

that always happens, cop pushed mine up so that i had to take the class and had more points.

read the sticky in w.e. section it's in. I dont know about the states but i know in canada the cops have to be able to show you what speed you were doing. Did you agree with the cop, don't agree, ask him how fast you were going(don't sound like a smartass of ur fu**ed). If he can't tell you, he can't legally ticket you. My best friend's dad and sister are cops, my dad was an auxillary officer and im going through to be a cop. You should be able to fight it with no problem, i'll ask about it to make sure.

thats what I thought, I wasn't thinking at the time and didn't ask to see the gun he clocked me with.

Yah, but it changed my whole driving habits and stuff, now I'm too paranoid about cops, so I almost never speed now. :o:

In order to write an official ticket, he needs a readout on a radar. Just "pacing" and judging someone is speeding can give them reason to pull you over, but they can't write a ticket on mere guessing.
take into consideration what it would take to fight the ticket... court fees, lawyer... the class might be easier. In NE, you can take the class once every three years. I don't know about where you are, but if you burn your opportunity and take the class, keep it cool until you're able to take the class again.

They do have rear facing radar mounted in the rear window that they can clock cars coming at them from behind with. They also use it when on the other side of the highway. If you pass them on the northbound while they are southbound they check your oncoming speed vs the rear radar speed to see if you even bother to slow down. It's not like the old days where everything was a handheld radar gun that you can easily see...
I have a 1k commute from work to home each week for the past 8 yrs so sadly Ive had the chance to get to know speeding tickets & the rear mounted radar.

take it to court....there always there...ask them to see the calibration
machine to see if it was calibrated that day with the tuning forks before operations...then also ask how the calibration is done...if he doesnt know what his talking about then you can easily get out of the ticket =) :hitit:

i've decided that im just gonna hope for the best and try to get the class. i requested it and hoping to hear back from the court soon.
i could've fought it but i doubt that i'd win. its a small county and i bet the judge and cop are like family. haha.
i've learned my lesson. i usually never speed now. i hate dealing with cops.

I would try to take Defensive Driving. If you have already taken DD, then ask for deferred adjudication (probation). With that, you will be on probation for 90-180 days, then your in the clear. However, if you get another ticket in that time you have to pay both and can not take DD.

Your dad is right, but you can only ask when you are stopped. Now all you can do if you chose to fight it is see if the officer is up to date on his certifications.

Im sorry but according to Texas Transportation Code 543.010 Specifications of Speeding Charge it states that: The complaint and the summons or notice to appear on a charge of speeding under this subtitle must specify:
1)The maximum/minimum speed limit applicable in that district or at the location: and 2) the speed at which the defendant is alleged to have driven.

But, it sounds like he did hit you with speed detection... as you say he was pretty much on the $ w/what you were actually doing. They do have rear facing radar mounted in the rear window that they can clock cars coming at them from behind with. They also use it when on the other side of the highway. Not just rear mounted... but bi-directional.. one facing forward on the dash.. one facing to the rear on the back deck.

my simple answer, if you dont want a speeding ticket dont speed.
ive talked to a trooper before he said their radar system can work from a little less then a mile away and just pay the damn ticket

Here's what I would have done.
When the cop slammed on his brakes to get behind you, you should have done the same and pulled over immediately. When the cop would have made it to your car and asked you what you were doing, explain to him that you saw the same rabbit/dog/raccoon/unicorn he saw crossing the road when he hit his brakes and it scared the **** out of you. You pulled over to regain your composure. Kindly thank the officer for coming and checking on your well-being, but state that you are going to wait a couple more minutes and then continue on your way.
You have to be able to think on your feet.

and yea, you definately need to ask about your speed exactly at the time you get pulled over. But if he can't prove to you he can't ;egally ticket you. At this point, your better off to pay the ticket and not speed. Courts and lawyer fees will cost you probably twice as much as the ticket. My friend is paying 325$ an hour to her lawyer:S good luck though

Cops can get away with alot.. My step-dad is a cop and took a class on visual speed reading. Talk about stupid. He can look and 'guestimate' how fast you are going, and write a ticket for it.. He goes to court for it all the time and ofcourse they believe him.

rarley do officers abuse their power, they will most likely use thier knowledge to help them out on patrol. and they have validity when using this tequnique and it most likley will be held up in court.

That is 100% correct here in Texas as well. All he has to say is your alleged speed. Its up to him in court to prove that you were going that fast. I have seen an officer first hand guess the speed of 20 cars coming down a road and had their speed +/- 5mph, with a radar behind his back with their real speed. He had more then half the cars speed spot on. Now you say 5 mph is a lot but how many time have you been pulled over and the officer said you were going xx fast but he going to

You are correct, but at the same time, it is ease to guess the speed of a lager object than a smaller one. Furthermore, look at people who watch a lot of baseball they can guess the speed of the ball thrown by the pitcher why, because they watch a lot of baseball. Now look at traffic officers that watch cars drive by all day, because of this they can guess the speed of cars accurately.

YES WE CAN clock people who are BEHIND US. The equipment in my cruiser is equipped on my dash and in the rear windshield. I have 2 gauges, one clocking cars in front, one behind...

I've stopped people for speeding who were originally behind me. Their arguments against it are some of the same I read here. It may be unfair, but if the law was being followed, no stop would have been made for speeding...
Bring a copy of your driving record with you to court and this may get reduced (or you'll get a PJC which disappears in time from your record and doesn't hurt insurance rates).

tracing, he could have saw you coming and used road markers to find out how long it took you to get to them after he did, and can mentally calculate your speed from how fast you gained on him and those road marks.

Hahaha, rarley?? I don't know about where you are from.. but I go on ride-alongs with my step dad and his buddies, and they do nothing 'but' abuse their power.. I also work for the Sheriff's dept. for another county and ride along with the deputies and they 'love' flexing their power.

i had a friend who was a cop in minnesota, and gave me a lot of 411 on what a cop can, and can't do. he has a 50/50 which means only from the front and 5 lanes across from each side, a cop can't clock anyone on a curve, downhill, uphill, due to the momentum of the vehicle, but you might be able to fight it if the ticket has an aproximate speed, and with his radar gun it should print out the speed you were going as well as his speed. either way you can still request traffic school, fighting it shouldn't affect you asking for school.
