so, i was at this car meet here and we all start heading out together after being in a parking lot for a while. Obviously there are many modded cars (HIDs, exhausts, tinted cars, etc.), but mine is among the few that is completely stock (not counting the s2k antenna). So I take my time talking with my cousin and am one of the last to leave. All of a sudden a cop pulls me over. I hand him my license (im still using my Puerto Rico license since i havent changed mine to NY yet). He thinks its a fake license and starts asking me all the info on my license to see if i know it. Then he leaves, and after 25 minutes comes back with two tickets. One for being an unlicensed driver (WTF my license is valid here for a while) and the other one for having a "loud muffler" YES. LOUD MUFFLER when i have a stock exhaust. W T F! So he assumed bc every other car i was with had a loud exhaust, i had one too.....

seriously what is going on with some cops these days.....

Fight the ticket! You'll win, i.e. it's stock. Hell I'm going to try to fight mine and i have a kauzma. Just double check the section number..

So you get the officer on the stand and ask him questions like this...

Officer, you testified (or issued me a summons alleging) that I violated section 375.31 of the VTL. Can you please tell the court what NY State Vehicle & Traffic Law section 375.31 states?

Officer, if you do not know what NYS VTL 375.31 states then how do you know I violated it?

Officer, what was the decibel level of my vehicle's muffler on the morning of August 27th, 2005?

Did you measure it with a sound level meter?

Why not?

Are you a trained expert in estimating the decibel level of a vehicle's exhaust system?

How can you quantify that judgement?

What's acceptably loud, what's too loud, where's the line drawn between the two?

Where's the borderline between adequate and inadequate?

How do you know I modified the exhaust system?

(Be ready for a response like: "I know a loud car when I hear it....ask him how he can quantify that judgement....what's acceptibley loud, what's too loud, remind him that the first thing a Harley driver does is install straight pipes, no mufflers whatsoever, why don't you bust them...?)

So if you didn't measure the decibel level of my vehicle's muffler and you're not a trained expert in estimating the decibel level of a muffler, how do you know it wasn't adequate as per
NYS VTL 375 31?

(he'll say he knows it was modified, ask him how he knows.)

Did he leave the scene and come back after 25 minutes or did he go to his car and come back after 25 minutes? While I think you can fight this, if he left the scene you should have too. ;)
