ima senior in high school. tomorrow is my last day. so today woke up and showered. left at 7:38 or so and had to be at school by 7:45. totally do able. normally i just FLY down this one road. i live in the country btw. but a damn subaru impreza was in my way. so i had to slow down and i was going to take it after a turn, so i was too close to the soobs bumper, but i shifted up into fifth, and slowed down and decided to play safe. a little bit down the road i look in my mirror and see the lights. pull over, have my belt on, car is legal, have my license, have registration, have insurance, go me. tells me i was going 10 over and tailgating. i pleeded and told him i had a final in like five minutes and he just didn't give a ****. btw, i really didn't have a final. so he said do you want a citation for speeding or tailgating. i, of course, said neither (but was being respectful and not a douche) so he said alright, went to his car. and came back. i got a $109 ticket for tailgating. at the bottom of the ticket where it says notes: it says 10 over. so i'm ****ed. this isn't my first ticket, but i have zero points on my license. i'm definitely going to fight it, but do you think a final is a valid excuse or should i just say i was going for a pass, then realized it was a no passing zone, and slowed back down. i need some advice on what to say to the district justice office. thanks guys/gals.

I wouldnt have said anything about a final. Your pretty much admitting guilt since you have a reason to speed. Sounds like you can fight it though. As far as him writing that you went 10 over on the bottom, does that mean anything when it comes to points on your license?

Pay the ticket, you were speeding and tailgating.
There is no reason you can give to legally get out of that.

pay the ticket and learn your lesson, don't speed and maintain a correct distance.

that'd be awesome. and i'm pretty sure i wasn't speeding because i was still in 2nd and the limit is 50 and if i was 10 over, i'd be redlining and i know i wasn't because i was prepared to pass. i'm pleading not guilty no matter what, so no thanks on the pay the ticket advice. just looking for some advice and what to do/say.

you really don't get much of a plead on a simple traffic ticket. you either pay the fine or you...don't and then whatever that is i'm not sure. you may be able to talk it down to a non point offense like window tint or something, but you will pay something.
ask for court supervision and then be more mindful of your speed and following distance in the future. supervision means that the points are pending for 6 months to 1 year if you get pulled over again, its similar to parole. if you don't mess up then the ticket and points go away, if you do mess up again then you get the points and a harsher penalty.

Your word against his.
Teenager in a "sports car" vs seasoned law enforcement officer.
Hrmn, who is the Judge going to put more faith in?
Good luck though, hope we don't get the "Well I totaled my Celica thread" anytime soon.

naww, i drive pretty safe. hence the responsible thing and being late by slowing down compared to the reckless option of passing that car. i just wish the cop wasn't at the spot i was going to pass that car.

Ironically you were more late due to being pulled over.

You could easily plead guilty with "extrenuiating circumstances". Just tell the judge you were going for a pass and then backed off. That would explain the tailgating and the speeding, without having to lie. You may still have no points and a smaller fine.

i got pulled over for something like that before...good luck with it but then again mine was 59 in a 30:D so i was screwed from the begining
naww, i drive pretty safe
sometimes you can be the safest driver in the world when you are driving, but sometimes an idiot can hit you ( god forbid for anyone ) and then you can say bye bye to your car.
once your lie didn't take you out of the situation.. better pay the tickets lol..
TRUST ME, you need to do that . . . lol
i have zero points on my license.
International License FTMFW ! no points on my license or any of that BUT .. if i was to do something very serious or speed like a mofo, i can be taken to Jail, because from what i know \ hear, i can't have my license suspended or taken away from me >> because it's International :D.
if i were you, when you go to court ( not sure if that's what is going to happen ) then just confess that you are guilty, and make sure all the registration, license, tag, insurance, bla bla etc is up to date and valid, and explain the situation in all honesty, the judge might knock down the fine, it happened 2 a freind, he was doing 75 in a 25, his car got impounded, got issued 2 speeding tickets in which each fine was doubled, registration expired, tag, license, and had his license suspended, he said the truth that it was his fault and he confessed guilty, what excuse can you possibly think of for going 75 in a 25 ( unless if it was an emergency )? the judge ruled over all the fines, got his license back, and had to pay for 1 double'd speeding ticket + impound fee, he was VERY lucky.
Hope that helps ..

Just pay the fine. A judge is not going to let you off the hook because you were speeding up to pass. Legally you can not "speed" to pass another car. Every story I have heard or told people I always say I was going slower then I was since it seems hard for people to really blame themselves.
You were doing something illegal, save your time pay the fine, take STOP class and your insurance will not go up.

Your a high school senior. YOU WILL NOT GET OUT OF THIS!!!!
Those two phrases will go hand in hand. All this good driver bullsh!t you are trying to feed us doesn't matter much to the judge. If you go to a safe driving class (which is only 70$) BEFORE you go to court, the judge might drop it (thats what happened for me on my first ticket). You will still have to pay court fees so it will even out with the amount you would have spent on the ticket, but trust me, points on insurance when your not even 21 yet will MURDER your payments.
Do not explain that you were trying to pass the guy. Your only saying that you were trying to speed.

go to court and try your best, usually if you just show up you can think of something to say to get it dropped.
i went may 29th to my case, had speeding on a highway and headlight infraction(fcukin douche didn't even give me a warning)....tell the judge your a school student (I've been to court 3 times and this helped MAJOR every time, especially when your on a 7 hour trip from college and need to piss :fawk:) . . . but yeah be nice to the judge and explain yourself and BE CONFIDENT!...just ask the judge for traffic school, you most likely will get it and get your ticket dropped with no fines except court costs.

be glad he didnt charge you for the 10 over.. you'd have around a 400-500$ ticket
considering state troopers charges are higher then normal officers.. also DONT lie.. they have footage and audio of you saying you were gonna be later for a final.. pay it and be happy with you getting off that much.. even if he dosent have record of your speed AKA radar or etc.. you admitted it
