Well, my arbitration papers are coming in, and im gonna have to fight toyota corp. :( do u guys think i have a legitamate case?

toyota sux, I spoke to my regional representative, not sure if he's sympathetic or not. I wouldn't budge an inch, he wouldn't budge an inch. He said I"d have to pay 750 to tear down the engine just so he could tell me whether it's under warranty. I know my intake has nothing to do w/ thrown rod, yet like...they claim it is before they've done anything. The dealiership I'm at hates me cause of the hell i've caused so what's the chances they'll say it's not the intakes fault (which it really isn't the intakes fault). I'm going somewhere else, and hopefully it'll work out. Gonna go to smallc laims court or arbitration. They claim a bit of duct tape I had on the ecu tube made it unprofessional. Pah, I just cut it to short, but it works fine, it just looks stupid. Uhh, I cut the ecu tube shorter rather than making it longer when putting in my intake. Anyway, arbitration is usually pretty fair because it's 3rd party and state pays for it, not toyota. In addition, they have to prove you "drove it hard", by showing that it was overreved pretty mcuh. Other than that they have no proof. ASnyway, good luck.

i just hope i have a case, im thinking i should find a lawyer, but some people say its not needed

Small claims court is the way to go. If a waranty is not honered, they are in violation of state laws in addition to violating a contract with you.

The total burden of proof if a mod caused a failer or not is all Toyota`s responsibilty.
