Leaving work today to go home for lunch I was pulled over for supposedly doing 52 mph in what I thought was a 50 zone. The cop said I was clocked with a radar by another officer and the information was relayed to him. He wrote me a ticket for 52 in a 40 zone. I told him I was doing 50 according to my speedo and that on that particular stretch I was in fact allowed to drive 50. (I was in fact doing 50 on my speedo since I spotted the radar car when leaving the office, but I have slightly bigger rolling stock so my actual speed is always slightly higher than indicated :chuckles: )

After argueing politely I asked him for proof of the radar clock and he said he couldn't give it to me and that I should just go and pay the fine. I disagreed to which he told me if I was smart I'd use my right to remain silent. I told him he could write everything I said on the form, which he then did. :D

Unfortunately for him, the article infraction he cited says that the max speed on the autoway is in fact 50 mph, unless otherwise indicated. Unfortunately for him again, on that particular stretch where I was clocked there is absolutely no speed limit indication, which means that the max is by default 50. So I took my form and proceeded to drive all the way back and took pics of the entire stretch to use in my defense.

Now, where's the profiling part you say? Well, there was a lady in a garden variety family car slightly ahead of me which was clocked first (all cars were clocked according to them, which I certainly believe to be the case) and at the point where the radar was she was going faster than I was, as she was putting more distance between me and her. If I was clocked at 52 then she must have been doing at least 53-55 to be pulling away from me, yet she wasn't pulled over.

So I'm gonna be fighting this next month on the basis that he wrote on the form that I declared that I was doing 50 which is according to what was allowed.

The officer still has you doing 52, and if its in a 50 zone, you're still being cited for speeding. It wont be as cut and dry as you think. You still have an uphill battle to fight.

I would exclude any profiling claims as they are impossible to prove and will only make the judge want to not read your case.

Stay away from the profiling bit and on top of the fact that he refused to show you your speed.

Looks like you got all the proof you need to say in your defense, I bet the DB cop won't even show up, whatever you told him, put him in a stupid position, so maybe even knowing hes wrong he still wrote you a ticket. I wouldn't worry about loosing.

I did 65 in a 35 once......once I spotted the cop and slowed down before he noticed......the other time I did it I was doing almost 70 in a 35 and the cop was going the other way.....didn't notice him until I was already doing 70......

Anyways they always catch the last person.....doesn't matter if the one in front of you is already going faster. If they can catch you first they have themselves a ticket.Somehow I haven't ever gotten a speeding ticket though......

Over here there are no points system and they usually don't fine if you're not doing more than 3mph (5Km/h) over. The basis of my defense will be that it was a 50 zone and I am by law allowed to drive that and I was consciously trying to keep my speed at 50 (heck, it's what I drive normally). I would not have bothered to argue with the cop if there had been any signs depicting the road as a 40 zone.

Actually i guess it could depend.. but around my area. they catch the front person, not last. me and my friend were speeding and he pulled over my friend and he was in front.

You're an idiot.

I'd totally agree. And I have done worse. I was very young and stupid at the time.

On the highway on my way to work behind a Saab. Speed limit was 65 and we were doing about 75 when a trooper got us on Radar/Lidar and pointed to wave us both over to the side of the road. The Saab began changing lanes to pull over, I (stupidly) decided I was less than 1/2 a mile from my exit and there was no way he could catch up in time. This led me to downshift to 4th and punch it, arriving at work 5 mins later with my heart pounding and no ticket.

I should have just left for work 5 mins earlier!

Point is people do stupid things in situations.

In my case they had plenty of time to stop the lady in front, the cop was up on the street way before the lady got there, she moved to the left lane when she saw the cop and visibly slowed down and even then I wasn't catching up with her. When he told me I had been pulled over for speeding I knew it was profiling. Shortly after they pulled over a guy in a Mustang that was doing 53.

I think cops do profile the celica. It's a "sports" car.

I was turning left on a major road at like 2 am. A trooper was across from me coming in the opposite way. As soon as he saw me, his blinker was now right (haha). We were stopped at the light for about 3 mins.

Long story short I shifted at like 2.5K and I told my passenger I bet he will pull me over in 10 seconds. Yep. But I got out of the ticket. I was told my exhaust is too loud?

The hearing was today and the outcome was pretty funny. I was ready to make my defense but before I even started the judge asked me when the thing took place. I couldn't remember and neither the judge nor the attorney could find the date written on the ticket so they dismissed the case without me having to say anything in my defense. Well, I know when to keep my mouth shut and walk out. :chuckles:

I have yet to get profiled by cops here *knock on wood*. My car even has a cf hood with a raised scoop and a "JDM style" license plate mount. I always go through 101 traveling at 70-72 MPH, and there's usually a lot of cops sitting by the overpasses.

Went through Oakland, SF, Hayward, Fremont, San Jose; basically all the hot spots and cops don't really mind me.
