View Full Version : Framed for huge ticket!!! :(

so i was just in grande prairie ab visiting some relatives and attending a company golf tourney and was driving back to edmonton on highway 43 on sunday. jsut after whitecourt i was following a sherif out of town (so obviously i wasn't speeding) he pulled over to the side of the road and got his radar gun out, i passed him doing 96 km/h (speed limit is 110 km/h). he didnt move and i kept on going down the highway.
i had just purchased rims and tires in Grande prairie on saturday night, and there was a balancing issue with them (shakes at 120 and uncontrollable at 140 km/h). i had my cruise set for 112 (2 over isnt gonna get me a ticket) another spectra blue celi passes me going really quick, knowing i cant keep up to him because of the balancing issues i keep at my speed. 2 mins later i see cops in my rearview quite a ways back and i remember thinking im glad i didnt speed after that other celi i didnt know there was a speed trap back there.
they come up really quick and hwy 43 being a 4 lane highway and me going faster than the other traffic by a little bit im in the left lane passing a truck and trailer, i see thier lights and i speed up jsut a bit to ge in front of the truck so that i can let them by..... their pulling me over?
2 cop cruisers followed a minute later by a third pull me over at twp rd 583 (this is over 20 km from the first cop) its pouring rain and a cop comes to each window, so i have them both rolled down. the cop on the drivers side asks me to do my window up 6 inches (checking for tint on front windows) i dont have any... the cop on the passenger side says he clocked me doing 164 in a 110 zone? after this he said that he had to "max out the cruiser for quitea while to catch me" which is pretty fast, i dont know how fast but its a police cruiser so im guessing at least 180 km/h
im confused here, but then i put 2 and 2 together, they clocked the other celi which just happened to have black rims and be spectra blue (just like my car) i asked the cop if he was sure it was me because i had seen another blue celi (00-02 with black rims) and i explained to him the description of the car and how the front bumpers were different so he could tell it wasn't me. he said "i seen this car, and my evidence can confirm it" and referenced towards mine.
he went back to his cruiser where i pulled out my cell and a pen and paper and noted the time, the road, and everything i could and wrote it all down. when he came back to my car he issued me a summons and asked if i understood, where i again asked that he go on ahead after this and find the other celi, he refused (probably thinking i made it up) i then started to see what evidence he actually had and was prepared to go to jail that night and have to prove my innocence, so i asked him if he had a picture or a video, something with a plate. he replied ?" i have a plate now" in a very rude tone of voice. i then asked him what i could do to defend myself against the charges, whether i needed a lawyer or what and he said "that is for you to decide come the trial". i got one more question in (hoping to prove i knew a bit about the law in a last ditch effort for him to stop trying to pin this on me and go after the other celi) i asked him how i went about trying to sapina his dashcam, he said it would be in a bundle wiht the radar matience records and all of that. he then said "this is getting nowhere and you can defend yourself in court, you are free to go"
i was right pissed off at this point and finished writing down the last of the information i could, taking the time to make sure he left before me so i could get his plate, i did. he pulled a u turn as soon as he could and went back to whitecourt. they didnt even attempt to go after the other celi and ( according to business collegues of mine, there were no more cops on the road after that point, so it's not like they were watching for him)
so now im stuck with a 54km over the speed limit ticket, a mandatory court appearance, and the possibility of losing my licence and i have no f**king idea what to do. from how they acted i can draw a few conclusions though
- they checked for tint, the other celi had it i didnt
- they had no plate till they pulled me over
- they lost sight of the other celi for quite some time (maxing out cruiser confirms it)
i definately need a lawyer for this one, but as far evidence goes this is what i have gathered besides the notes i took on the side of the road
- from a buddy who lives in whitecourt they were most likely on a hill called 7 mile hill (which after going back to check was 17.5 km from where i was pulled over
- a text message that i sent to my parents saying that i was going through whitecourt at 5:44 pm ( i was pulled over at about 6:08) if i were really going as fast as they said i was wouldnt i be a lot farther than around (im guessing here but id say 30-40 km out of town)?
-pictures of the multiple hills in the 17.5 km stretch proving that they would easily lose sight of a target, (especially if they had to max out their cruisers for a while)
- i need my tires rebalanced and plan to get the report saying that the car shakes horribly at 120 and would not be able to travel at the speed they say they clocked me at without shaking so horribly that i could not keep it on the road
if you or another member was driving around highway 16 (the yellowhead from edmonton to jasper which hiwhay 43 joins onto to go to edmonton) or highway 43 (grande prairie to the yellowhead) around this time i would sincearly appreciate statements that you were doing so (not to say it was you that was speeding, but that i was not the only spectra blue celi in the area at the time (if 3 or 4 were driving in this area at this time it would really help me), although i don't know how well they would hold up in court, testimonies would make me super grateful although that is asking a bit much.
- if you were the guy/ girl who actually got clocked i think that this is the least you can do!!!!!!
well thats all i can think of, if you can help me out thanks in advance

Sorry. I live no where near you and mine is black. I just wanted to say: What are the odds of that sh!t?:faint: How the fvck does your twin (to the untrained eye) just happen to be breaking the law at the same time you're around? I bet you wish you had a decent set of balanced rims. Then you would have been keeping up with the other Celi and gotten away.
I highly doubt anyone will come forward. If I was you, I would keep doing what you're doing in regard to preparing to fight it. Good luck with it.
It could be worse. They could have committed something along the lines of vehicular homicide....;) Could you imagine being balls deep in that scenario?

go to court and im sure his evidence will not hold up. unless your plate is visible on his cam or something i dont see how he can prove it was you. Any distinguishing marks on your celica? stickers or something?

thanks
nope nothing distinguishing about it. im a 19 year old male so i didnt want it to stick out too bad, when i lived in grande prairie there was a couple months where i owned the only blue celica in town that was on the road (there was one for sale but it was parked) so i tried to make sure i blended in a bit because cops used to follow me around, never pull me over, but jsut follow me for around 15 minutes at a time.....
it was stock till the day before this where i got black rims..... too bad 90% of the spectra blue celicas out there have black rims, only thing distinguishing about it is that it has the 03+ bumper and it doesnt have tint.
@n20vvtl-i ya no doubt, if i knew why he was going so fast i would have just pulled off to a side road and jsut hid in the bush for a while, there were enough of them around....
anyway ill keep you guys posted, if you can think of anything that might help me out let me know

hopefully, but it's my word against the word of 3 officers that pulled me over.... hiring a lawyer will help, but it was raining pretty hard so im hoping that the judge doesnt mistake my car for his. mind you it's innocent unitl proven guilty... but ya hopefully it works out, and if it doesnt hopefully the insurance doesnt rape me after so i can still keep my baby.

If you have a clean driving record before this, you are truthful and you hire a lawyer I wouldn't be too scared. With a lawyer and no previous record you should be able to talk your ticket down to a lesser ticket at least.
Bottomline though, get a lawyer. This is not the place to get legal advice, and neither are the cops who pull you over.

kinda like my ticket... they gave me a "Speed Racing" ticket AFTER i traveled around 15+ blocks away from the spot they said i was racing... I took it to court, even had the officers confirm i didnt pass the speed limit once (30mph)... STILL slammed me the book reduced the fine. Judge asked me if i had anything to say for myself, i asked him what he ment and he replied " To make me go easier on you... are you a good person, do you pay taxes, do you have a job.. " I was pissed, and threw it in his face because thats not professional to ask of a Judge nor relevant to the problem...
Anyhow, cant win em all buddy... Being 19 with a modded sports car, your a straight target

That's exactly what I was thinking... Profiling will probably get in the way and prevent you from winning the case. To them you're just going to look like a smart ass teenager lying through your teeth to avoid the ticket. It sucks because you really were just in the wrong place at the wrong time....
I'd hound the officer for all the evidence he has because the more specific and detailed the description of the speeding car, the better chances you have of distinguishing it from yours.
Keep us posted man, best of luck.

well i think you got screwed over because you threw it back in his face, i intend to be polite to the judge
its not a modded celi either, it has rims and tires and thats it, was planning on doing a lot of work this summer, but ill hold off on the install till after the trial
whitecourt i belive is the trianing grounds for police in alberta, and every young officer there seems to have a need to prove themselves, not to mention that every officer that was present when i was pulled over seemed to be under the age of 30.
hoping the judge can see this as young officers trying to make a name for themselves at my expense and throws it out because theres no case against me :)

:blah: If you weren't a smartass and an ******* to the judge he probably would still reduced the ticket more or even thrown it away, but since you had to be a smartass and call him out on going "off the road" he probably felt you shouldn't have even gotten away with what you did.
And in no way did he "profile" you. Asking you simple questions is not profiling. In no way did he pick you out from the rest of the population because of your age or skin color.
That's what you get for being stupid. Have fun with a street racing ticket on your record.

the tint could save you along with the dash cam.
If they look at the dash cam then they should see two blue celicas pass by, one with no tint traveling the posted limit, the other obviously breaking the law.
You can also drive that stretch again and time it with a stopwatch, the distance from where the cop was to you(the locations can be confirmed by the police department, they have tracking devices and logs of where there officers are at all times). You noted the time down of the pull over, which can be confirmed by the dash cam, and call in over the radio by the officer.
Have video of proof for timing, and if your times match up, then it couldn't be you, because if you were traveling the claimed 1** km/hr then the time would have been considerably shorter. Unless you stopped and pulled over for a sec, or drove considerably slower than the posted limit, the cop wouldn't have caught you.
Time is the key to winning this case, If you can prove that the time from when the cop started to chase w/ his given speed to catch you, and your traveling speed from the cops parked location to the place of pull over don't match up with the speed recorded, then you should win. The more inconsistencies you can find with the officers story the better your chance of winning.

sorry man didn't mean to offend, it jsut made it sound like you "threw it back at him" in a polite way i guess like "what does that have to do with the case your honor" or something along those lines. idno maybe the fact that i actually plan on practicing law will help curry favor with the judge, every little bit helps i guess.
@2kGtrd
ya that's what i was thinking about the timing thing, never thought of the stopwatch though thanks. as far as the dashcam goes it was pouring rain so im pretty sure that it is going to be useless, at best super blurry with a really fast blue streak going past and a slower same colored blue streak going by at a much slower rate although i can remember a ford car (believe it was a fusion although could be wrong) that had a pretty close color to mine, i guess that kinda helps because the more vehicles that look like mine the better. either way its not the evidence that im worried about, i dont wish to fall victim to profiling.
either way i have to find a lawyer soon and start the procedures to sapina thier evidence
ps got my tires rebalanced today, on the workorder it says that they were f**ked up and that it was fixed, have that stapled to the originol invoice and they both have dates on them. hopefully it helps a bit
thanks for the help guys

As long as there are two blue blurs that go by. This way the officers judgement is impared, and all accredidation can be thrown out. Esp. if it was raining that hard that they couldn't tell if it was you or not.
The stop watch was only ment to accurately time yourself.
ex.
speed = dist / time.
You were going 96 km / hr. time from pass to pull over is = 2 min ~ 0.03 hrs
distance = 0.03 * 96
~2.88 km
if they clocked you at 164 km/hr. w/ same distance then it, by definition, would take the officer 1 min to pull you over.
Make sense:shrugs:?
This won't hold water since more time would be required to catch a faster vehicle than a slower vehicle.

it more than sucks, i have to shell out money to pay a lawyer and pay fines for something i didnt do, for a while there i was pissed off enough to counter sue, but like i mentioned earlier whitecourt is possibly a trainign grounds for new cops, if i counter sue and win and he loses his job or gets seriously reprimanded will i then become the biggest blue target on the road?
if i win ill be poliute about it, but i do plan on going into law and i believe that i ahve one hell of a case, this retard cop pulled over the wrong guy to try to make himself seem important. regardless of how polite i am in trial this is gonna make him look retarded and im still gonna be a target, just not quite as big of one.
after this is over (if i still have money) im doing a lot of work to the car, only way to ensure that i dont get bent over like this again is to make my car look unique so that it doesnt get mistaken for a different one.
ps on a side note i did get a statement that says the tires were not balanced properly, i cannot get a statement from the tire shop as they flat out refused to drive the car or to go for a ride to verify that it does shake doing 120 which sucks, but i guess having paper that tells that the tires were statically balanced (jsut up and down) and not dynamically balanced (up down and side to side) shows that there is truth to the claim that the car was not capable of speeds like that, they can't disprove that it wouldnt so i guess it helps, even if only slightly
thanks guys ill keep you posted

lol well it doesnt matter who did it, i doubt they are a member here anyway, but i just posted this in hopes that there were a few members that lived in alberta with spectra blue celis who could vouch that they were on the road, so that they can't say it's the only car like that that was driving it must be him.

dude, i had about the same thing happen in my town. but the difference is i got poned for a 25 mph over in a construction zone (55 mph), when there were mini vans passing me to the left, while i was in the slow lane. his reasoning was "you dumped your speed about 5 miles back" well, 5 miles back it was 75 mph, so of course i dumped it to a legal 55 mph. i'm also a college student, and will get my lisence suspended if i don't fight this, so i definitely get what you're going through. good lake mate, definitely a stressful time.

I'm hoping that this isn't like my experience, but I'll tell you what happened. I got a speeding ticket. Eh, not the first or last. Then I went to court to plead not guilty. Well, if the cop isn't there, you're off. Not guilty. That's what it USED to be. Now it's you go to court, and if you don't plead guilty, you get ANOTHER court date. I would suggest at least consulting with a lawyer. It will save you big $$$ in the long run. I respect the cops... Until they start ****ing with me...

I got pulled over and it was my first ticket, I have a spectra blue tsunami.. Nothing like your case but the cops in Alberta seem to be really dumb. I wasn't sure if the demerits would be effective or not because I never really looked into it. I asked him and he said no there shouldn't be but I'm not sure. Any speeding ticket you get will have demerits... :thumbdown
I'm in Calgary btw. Your date is coming up soon, good luck!
