Ok here is the skinny, i was driving to work travelling in the left lane going about 35-40 mph (going the speed limit) when a girl in a Mitsubshi Montero going to make a right turn into a shopping center decides to make a left u-turn instead and crosses back into the right lane and into the left lane were i was....i slammed on the brakes but i was unable to stop and i hit her, completely damaging my car. I called the cops and the girl admitted to me she was completely at fault but when the cops came she said that i was speeding, now there are tire marks on the floor that look as if i was speeding but i honestly wasnt, so i want to fight her in court to repair the damages, now my question is if i was going more then 35 mph then wouldnt have my airbag deployed? what speed does the airbag deploy?

I need to win this case!

dang devin sorry to hear about that, did the cops measure your skid marks? cause they can tell you how fast you were going

contact lawyer...... get some witnesses.... some body had to see this. Nail her to the wall (or at the very least threaten to) for lying to the cops.

You T-boned her and you were both travelling the same direction. Only one way that can happen and it's not because of the guy facing down the street ;)

If anything the situation shows the retard tried to make a u-turn from the outer lanes which is already a big no-no :nono:

Witnesses are extremely important in a situation like this as without an impartial third-party witness

i want to go out tommorow and messure the tire marks anyone know what the messurements would be to calculate speed?

And i take it no one knows at what speed the airbag deploys in celica???

Really, the cop should have measured the marks. If he filed a report, then he needs that determination. I would fight her in court with the advice people have already stated, and try to make sure the cop is there. Ask him if he took measurements, and if not, why.

i dont understand how to calculate it but i went to the crash site and my skid marks go 33 feet then when i crashed the skid marks curve 4 feet to the left, how fast was i going?

weight of a vehicle is a factor to...i dont say weight as a factor on that chart

yea take pics of the surrounding area and the skidmarks also, i had a case a few years ago where a lady Tboned me and she tried to say i was doing 70mph when in fact the skid marks showed i was only doing 30, dumb!

exactly! that should win your case itself. You were going straight on a street where your supposed to be going straight and she cut across to the left on a street that she was either supposed to go straight or make a right. CASE CLOSED! If you get a lawyer explain that to him and he hsould have no problem winning your case.

Whatever cop you had is a freakin moron. I'm a military cop and I know the law pretty well. From how you explained the situation she did an improper lane change, she's at fault case closed. Bring that up and you'll get her on that.

lawyers are very expensive. Unless you sue her to cover your lawyer fees (consult w/ a lawyer because that's always free and see if they can do that), ut i mean, just for a simple ticket, it can be very expensive.

Obviously the fact you t-boned her on a straight street shows she's at fault, but she said your speeding and tire marks could play a big roll in it. Depending on how old you are, etc. if you rin college/high school check and see if any physics teachers can help you out. I'll look online for equations or wahtever, but this definately looks like something you could win.

Ok so they are going to fix it apparently, so what front bumper should i get Kaminari again? what else would you guys think would look good with Kaminari Side skirts, rear bumper, and TRD wing?

kaminari is what iw ould go with. Assuming i had the rest of the kit. Maybe a blitz urethane, but now i wish i had something urethane.
