well, it's kinda sucky that they can't even take a pic of their product they are selling!!! what the crap... what can i do? they're not using my bandwith, so is there anything i can do bout it??

you could see who has bid on it and email them letting them know that is a picture of your car ...

Was there a Copywrite on the pic they're using? If not, you can do nothing but e-mail the seeler and ask them to not use the pic of your car to sell their product.

well, there was a disclaimer on our website, not to steal our pix... does that count?

Absolutely. That's Copywrite infringement. You could even sue them if you wanted to.

I suggest you e-mail them stating the claim on your website... tell them to remove the pic promptly, or be prosecuted. Take a screen capture of them using your pic, tell them you have all the evidence needed to prosecute to the fullest extent of the law.
