that sucks man. same thing happened to me but instead of passing on my right some dude was backing out while parallel parked and hit my front right bumper and fender while i was parked. i swore i spazzed out for a min. luckily he lived in my building too so we didnt have to go through insurance and he just paid for the repair. it wasnt too expensive. g/luck with everything.

passing on the rite is legal in MA. if you're driving slow enough that someone can pass you, you shouldnt be in the passing lanes. in MA, on a 3 lane highway, from rite to left it is: travel, pass, pass.

ok, well heres what happened...

i was heading into the Home Depot parking lot in Bellingham (i doubt anyone knows where that is...) and i had to take a left to get into the parking lot from Rt 126. Once you take the left, the access road splits into 2 lanes. i took the left lane and the other guy behind me took the right lane. then the road takes a left turn and the right lane ends and merges with the left (hense why i was in the left lane). but as the lanes merge, the one lane is still kind of wide enough for 2 cars, but technically it is only a single car lane. and i was coming up to a 4-way and i was going to take a right (there is no stop sign in the direction im going) but i was in the middle of the lane. as i start turning the wheel to the right, the guy behind me decides to pass me on the right. and before i knew it, i hit his left rear door (he tried passin me pretty quick). so i got outta my car swearing up a storm!!!! i was so PIST!!! (who wouldnt be with my luck streak im on :(). so they guy writes down all his info and gives it to me. and then i asked him for his drivers license #, and he said no. so i was like, oh yea, LOL, the cops are coming anyways. so the cop shows up, we both talk to him, blah blah blah... but he didnt issue the guy a citation :furious:. that pissed me off even more!!! but after the other guy left i was talking with him and he was like it is wide enough for 2 cars, but it is in reality only a single car lane. so w/e. he said the ins company would probably go 50/50 with us. which is complete :bs:!!! so luckily i flagged one uy down who was at the 4 way and saw everything and i had my friend with me too in my car.

i just submitted my claim to the insurance company and now im waiting... we'll see how it all goes. hopefully i wont have to pay a cent, and i will get fresh paint on my kit :D

is there a stop sign involved at the 4way?
were you using your blinker?

seems like you did the rite thing by waiting for the police, and getting a witness that wasn't with you.

without a police report it gets pretty difficult.
..and remember even if initialy they vote 50/50, appeal it. take photos. get a written testimonial from your passenger and the other guy. police report (assuming it's in your favor).

passing on the rite is permitted if the road is free of obstruction & of sufficient width for two or more lines of moving vehicles when(chapter 89, section 2):

(a) the car about to be overtaking is making or about to make a left turn,
(b) upon a one-way street, or
(c) upon any roadway on which traffic is restricted to one direction of movement.


if you used your blinker i think it would the other person's fault. you would need the other guy and your passenger to verify that you did use it, otherwise it'll be your word against his.

see, the intersection is weird. i dont have a stop, but all the other directions do. so i didnt have to worry about that. but i did have my blinker on. so im guessing that is a + for me. and for the witness that wasnt in my car, he was at the stop where i was making my turn into, so he saw everything!

my previous 2 accidents involved a tree, and me driving a 93 Corolla into the rear tailgate of a early 90's Chevy CK pickup. the Corolla crumpled like a can and the pickup only had a couple of pain marks. so he didnt take it to the insurance company. so i never really needed to involve the police up until now. i was just so pissed and wanted to screw this guy :bang: for FUKIN up my car!!! so thats why i called. but im getting an appraisal next tuesday and hopefully they will total it (j/k). im thinking maybe adding some more damage to my front bumper and claiming the guy made the clips in my rear bumper fall out from the impact ;) just so i can get everything all done nicey nice :evil:

oh and you are right kia, without the police showing up, i would been screwed. the guy gave me false information on the piece of paper that he wrote all hios stuff down. he gave me PO Boxes and they were in towns that werent even close to the ones on the policve report. i am so fukin mad at that guy. after seein that he gave me the wrong info, i wanted to rip his head off. too bad it was after the fact though :mad:

am i driving like what? with a busted up car? unfortunately yes...... and i will tell everyone now, my car looks like SOOO much as$, im so embarassed. to be honest with you, i'd rather be driving in my winter beater, POS 1989 Chevy Corsica that i got for $100. but my Celica will make the trip to the meet. after i get it appraised on Tuesday, i have to roll the fender and i might even try to put my 18's on. we'll see how it all works out.

if only body work could be done in a day :-/

yea well i dont! but i'll be taking out my aggresion on my rental car from Enterprise starting next Tuesday at 4pm while my ghettofabulous car is getting repaired in the body shop :) i'll either be getting a Malibu or Stratus. cant wait :D
